Consent & Waiver

In exchange for participation in a play session, open play, and/or an event at The Brick Zone, I agree for myself and for the members of my family, to the following conditions:


I hereby certify that I am the adult parent, guardian, legal custodian, legal representative, physical custodian, or the person otherwise responsible for a minor child under the age of eighteen (18) years, and I consent to his/her participation in the entertainment activities offered by “The Brick Zone .”


I further represent that the child(ren)/participant(s) are healthy and physically able to participate in any and all undertaken activities.


I understand that while at The Brick Zone, the SUPERVISION and CONDUCT of the child(ren)/participant(s) below is MY SOLE responsibility.


I agree that the child(ren)/participant(s) named below, and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for play and participation in any play or event at The Brick Zone.


I agree to pay for all damages to the facilities of The Brick Zone caused by my or my family’s negligent, reckless, or willful actions. In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest The Brick Zone employee or official immediately.


I recognize that there are certain inherent risks associated with the use of the indoor play area and its accessories at The Brick Zone, and I assume full responsibility for personal injury to myself and my family members. I acknowledge that Lego® and Duplo® contain small parts and that it is my responsibility to ensure safe play with my child. I, for myself and the child(ren)/participant(s) named below, and our respective heirs, assigns, administrators, personal representatives, and next of kin, waive, release, and discharge The Brick Zone and its property owner(s) along with their owners, agents, employees and affiliates, officers, and members, for injury, loss or damage arising out of or related to our participation in any and all of The Brick Zone’s programs, activities, parties and/or the use of the facilities of The Brick Zone, to the extent permitted by law. This waiver and release shall apply to all risks, known and unknown, even if resulting from negligent actions of other guests or employees of The Brick Zone.


I grant The Brick Zone permission to use myself and/or my children in photography, videos, or digital media in advertisements and social media without payment or other consideration.


COVID-19 Risk Exposure: I acknowledge that the CDC, the State of New York, and other public health authorities have confirmed the contagious nature of COVID-19 and that there is an inherent danger and risk of exposure to COVID-19 in any place where people are present. As such:


• I further acknowledge that The Brick Zone cannot guarantee that I will not become infected with COVID-19. I understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including but not limited to other The Brick Zone guests and their families and staff.


• I, for myself and the child for whom I am responsible, voluntarily agree to participate in the services provided by The Brick Zone and acknowledge that by doing so, I am increasing my and the participant child’s risk exposure to COVID-19.


• I attest that neither I nor the participant child for whom I am responsible are experiencing any symptoms of illness such as cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, headache, sore throat, or new loss of taste or smell.


• I do not believe and have no knowledge that I or the participant child for whom I am responsible have been exposed to someone with a suspected or confirmed case of COVID-19 in the last 10 days.


• Neither I nor the participant child for whom I am responsible have been diagnosed with COVID-19 or have been subject to a state or health authority order of quarantine or isolation as a result of potential exposure to COVID-19 in the last 10 days.


This consent and waiver shall be applicable to all future visits to The Brick Zone.
